Terms of service
Last updated [[date this is published]]
These terms are an agreement between you and [[legal name of the business]] ("we", "us"), [[postal address]], about your use of Atomic Lab. By creating an account, or by using Atomic Lab, you agree to them. If you use Atomic Lab for an organisation, you agree on its behalf.
1. The service
Atomic Lab is an online whiteboard for sketching, planning and organising, on your own or with others. You can draw without an account; those boards are saved only in your browser, which can clear them, and we can't recover them.
2. Your account
- You sign in with links sent to your email address, so keep your email account secure. Anyone who can read your email can sign in as you.
- An account is for one person. Use your real email address, and keep it up to date.
- You must be at least 13, and old enough to agree to these terms where you live.
- Workspace owners and admins decide who joins their workspace and what they can do, and are responsible for that.
3. Plans and payment
- Free costs nothing. Only the workspace owner edits; everyone else in the workspace can view.
- Team is charged per member (guests are free), monthly or yearly, at the price shown on the Plan page, plus any taxes that apply. The first time you invite a member to edit, your workspace gets a 14-day Team trial, once per account. No payment details are needed for the trial.
- Payments are taken in advance by Stripe. When members join or leave, the number of paid seats changes to match, and the difference for the rest of the period is added to, or credited on, your next invoice.
- You can cancel at any time from the Plan page. Team carries on until the end of the period you've paid for; after that, the workspace becomes read-only. Nothing is deleted, and you can subscribe again or switch to Free.
- If a payment fails, we'll tell you. If it isn't sorted out, the workspace becomes read-only.
- We don't refund part-used periods, except where the law requires it. If we change prices, we'll tell paying customers at least 30 days before the change applies to them.
4. Your content
What you put on Atomic Lab stays yours. You give us permission to store, copy and display it only as needed to run the service for you and the people you share it with. We don't look at your boards, except when you ask us to help with something, to keep the service secure, or where the law requires it.
You're responsible for your content, and for having the right to use anything you upload.
5. Acceptable use
Don't use Atomic Lab to:
- break the law, or share illegal content;
- harass, threaten or abuse anyone, or share hateful content;
- share sexual content, or anything that exploits children;
- spread spam, scams, phishing or malware;
- infringe anyone's copyright or other rights;
- try to get around security or access limits, or overload or disrupt the service;
- resell the service without our written permission.
If something breaks these rules, we may remove it, make it private, or suspend the account responsible. We'll tell you why, unless the law or safety prevents it. To report something, email [[contact email]].
6. Unused Free workspaces
To avoid keeping data nobody needs, a Free workspace that no member has used for 365 days is deleted, with its boards. Its members are emailed 30 days and 7 days before, and signing in, or the button in the email, keeps it. Paying and trialing workspaces are never deleted this way.
7. Ending
You can delete your account at any time from your account page; see the privacy policy for what happens to your information. We may suspend or close an account that seriously or repeatedly breaks these terms. If we ever stop running Atomic Lab, we'll give you at least 30 days' notice and a way to download your boards.
8. The service as it is
We work hard to keep Atomic Lab running and your work safe, and we back it up daily. But we can't promise it will always be available or free of faults, and features may change. Keep your own copies of anything important; you can download your data at any time.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited. If you're a consumer, these terms don't affect your legal rights.
Otherwise, we're not liable for indirect or unforeseeable losses, or for lost profits, business or data. Our total liability to you in any 12 months is limited to what you paid us in that time, or £100 if that's more.
10. Changes to these terms
We may update these terms. If a change matters, we'll email account holders at least 30 days before it takes effect. If you don't agree, you can stop using Atomic Lab and delete your account.
11. Law
These terms are governed by the law of England and Wales, and disputes go to its courts. If you live elsewhere in the UK as a consumer, you can also bring proceedings where you live.
